I havent got the game yet, but I do know that the US courses and some other countries as well as jockey and trainer names are different to real life? Why is this? If it is compyright then how comes they have always been right in previous games?

Well, I think Mark has probably been taking a bit of a risk with the use of real names in previous versions, so perhaps he has decided the risk is now too high, especially as a game with 3D graphics now has the possibility to gain a higher profile. He knows that people will provide mods to update these after release, but he's probably not prepared to risk including them in the official release.
